Depends, if the parents are divorced, then only the legal guardian can file suit on behalf of their child. There was a Supreme Court case a few years ago in which the father was deemed to not have standing because he wasn't the legal guardian, so the case was dismissed.

I think (with no true knowledge on the subject) that law suits can be filed by anyone. If 2 people have differing opinions on the same subject (the child) then each of them can pursue their own will and file separate suits.
